The consumer has a period of two years from the delivery of the goods to invoke the legal guarantee of conformity in the event of a conformity defect appearing. During this period, the consumer is only required to establish the existence of the conformity defect and not the date of its appearance.
When the sales contract provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal warranty applies to this digital content or service throughout the specified supply period. During this time, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its occurrence.
The legal guarantee of conformity entails an obligation for the seller, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal guarantee of conformity gives the consumer the right to repair or replace the goods within a reasonable time and at no cost, in accordance with the provisions of Article 1649quater of the Belgian Civil Code. If the goods are repaired under this guarantee, the consumer benefits from an extension of six months of the initial guarantee.
The consumer may obtain a price reduction or the termination of the contract, with a full refund upon return of the goods, in the following cases:
1° If the seller refuses to repair or replace the goods;
2° If the repair or replacement does not occur within a reasonable time frame;
3° If the repair or replacement causes a major inconvenience to the consumer, particularly in the case of costs for the return or removal of the non-compliant goods;
4° If the non-compliance persists after an unsuccessful attempt to achieve compliance.
The consumer can also obtain an immediate reduction in price or the cancellation of the contract if the non-conformity is serious, without having to request repair or replacement beforehand.
The consumer is not entitled to rescind the sale if the lack of conformity is minor.
Any period of immobilisation of the asset for repair or replacement suspends the warranty until the asset is restored to its original condition.
The rights mentioned above arise from the application of articles 1649bis to 1649octies of the Belgian Civil Code.
The seller who in bad faith obstructs the implementation of the legal guarantee of conformity is subject to sanctions in accordance with Articles VI.83 to VI.94 of the Economic Law Code.
The consumer also benefits from the legal warranty for hidden defects in accordance with Articles 1641 to 1649 of the Belgian Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the item is retained or to a full refund upon return of the item.
